original drawings and artworks;

Purchases may be completed through the website's online checkout or, where agreed, by invoice and direct email communication.
The specific terms applicable to a particular purchase or service are provided to the customer before the transaction binds the customer.

Unless expressly stated otherwise, all artwork, drawings, photographs, videos, written content, website design, graphics, logos and other materials appearing on this website are owned by or licensed to Ivana Kutilkova.
The purchase of an original artwork, print or commissioned artwork does not transfer copyright or other intellectual property rights in the artwork to the customer.
Unless otherwise agreed in writing, copyright remains with the artist.
You may not reproduce, copy, distribute, modify, commercially exploit or otherwise use my artwork or other website content without prior written permission, except where such use is permitted by applicable law.

Products and Services
Original artworks and prints
Each artwork and print is described on its respective product page, including, where applicable, its dimensions, materials, edition information, price and other relevant characteristics.
Original artworks are unique physical works unless expressly described otherwise.
Commissions
Commissioned artworks are personalized works created according to specifications agreed with the customer.
Before accepting a commission, I will provide the customer with the relevant details concerning the artwork, price, payment arrangements, estimated time frame and other applicable conditions.
Because a commissioned artwork is created according to the customer's specifications or is clearly personalized, the statutory right of withdrawal may not apply where the applicable legal conditions for the exception are met.
Teaching
Teaching services may include private online lessons, workshops, demonstrations or other educational services.
The description of the service, price, scheduling arrangements and any applicable cancellation conditions will be provided before the customer purchases or books the service.
Where a customer requests that a teaching service begin during the statutory withdrawal period, any required express request or acknowledgement will be obtained in accordance with applicable law.
Prices and Payment
Prices displayed on the website are stated in Euros and include applicable taxes where required by law.
Before a customer completes a purchase, the applicable price and any additional delivery or other charges will be communicated clearly.
Payment may be made through the payment methods made available through the website checkout or, where agreed, by invoice and another agreed payment method.
Where an order is placed through the website and creates an obligation to pay, the ordering process will clearly indicate that the order involves an obligation to make a payment.
Delivery
Available delivery destinations, delivery methods and applicable delivery costs are communicated during the purchasing process or before an order is accepted.
Any applicable geographical restrictions on delivery and available payment methods will be indicated during the online ordering process.
Estimated delivery times may vary depending on the destination, artwork, production requirements and shipping method.
Unless otherwise agreed or required by law, the customer is responsible for providing an accurate delivery address.
Right of Withdrawal
For distance contracts with consumers, the applicable statutory right of withdrawal is generally 14 days, subject to the exceptions provided by law.
For goods, the withdrawal period generally runs from the date on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.
For services, the withdrawal period generally runs from the date on which the contract is concluded.
These rights and their exceptions are governed by applicable Portuguese consumer legislation, including Decreto-Lei n.º 24/2014, as amended.
Certain products and services are excluded from the right of withdrawal under the law.
In particular, the statutory withdrawal right does not apply to goods made according to the consumer's specifications or clearly personalized, subject to the legal requirements of the applicable exception. This may include certain commissioned artworks.
For services, the right of withdrawal may also be affected where the consumer has expressly requested that performance begin during the withdrawal period and the statutory conditions for loss of the withdrawal right are subsequently fulfilled.
The specific withdrawal information applicable to each purchase will be provided before the customer is bound by the contract.
Returns and Refunds
Where a consumer validly exercises a statutory right of withdrawal, refunds will be made in accordance with applicable law.
Unless otherwise required or agreed, the refund will be made using the same payment method used for the original transaction.
The consumer may be responsible for the direct cost of returning goods where applicable and where the required information concerning those costs has been provided.
Nothing in this section limits mandatory consumer rights.
Legal Guarantee of Conformity
Goods sold to consumers are subject to the applicable statutory guarantee of conformity under Portuguese and European Union consumer law.
This statutory protection applies independently of any voluntary commercial guarantee that may be offered.

Alternative Dispute Resolution (Resolução Alternativa de Litígios de Consumo)
Under Portuguese legislation concerning alternative dispute resolution of consumer disputes, businesses and self-employed professionals carrying out an economic activity and supplying goods or services to consumers are subject to information requirements concerning the competent Alternative Dispute Resolution (RAL) entities. These requirements also apply to businesses that operate online without a physical commercial establishment.
If a consumer dispute cannot be resolved directly, the consumer may use an Alternative Dispute Resolution entity that is competent to deal with the dispute.

The competent RAL entity may depend on the nature of the dispute and the geographical scope of the relevant entity.
The current list of competent RAL entities and their respective areas of competence can be consulted through the Portuguese consumer protection authorities.
Participation in an RAL procedure does not remove the consumer's statutory right to seek judicial remedies where applicable.
Applicable Law
Unless mandatory provisions of applicable consumer law provide otherwise, these website terms and the contractual relationship between Ivana Kutilkova and the customer are governed by Portuguese law.
Where the customer is a consumer habitually resident in another EU Member State, this choice of law does not deprive that consumer of the protection afforded by mandatory provisions of the law that would otherwise apply under applicable European Union law.
